My friend was banned yesterday when he was on college. On the day before he war not playing CoD ect, just GRID.
But on the US Release Date of CoD WE ( Me and my friend ) played CoD. He got banned, and i (for now) not. So its hard to say..

yeh im from sweden too, and i have played alot(!!!) of games before their release dates while signed on to Xbox Live, never played online as multiplayer though, but i haven't been banned yet.. and NO, don't blame the group Allstars, they all use the same method of using the releases Xbox Live-proof, and the only way u will get banned of course is to get on Xbox Live with games that haven't been released yet =P

well lol... it sounds rediculus.. they have released too many games, and why would microsoft even do that? they lose too much money, and in my own opinion, Allstars is one of the greater groups out there providing these lovely games for us and should be one of the only groups you should download from... never had any problems with them so far and i would say 3/5 of all my games are released by Allstars..

that i don't know sorry m8.. i don't know what exactly M$ is using to know who is banned or not, should be the model/serial number, which must be saved and accessible somewhere, but i don't know if it's on the HDD or some onboard chip (probably a chip since the Arcade system doesn't have a HDD), so if it would be the motherboard then you should be safe to use your own HDD...

Banned as of yesterday.
Didn't play any allstar releases or anything before street dates.
Played pirated games with machine disconnected
Connected machine to play legit copy of COD4 and Halo 3.
Still got banned.
I figured it would happen sooner or later but it chages nothing.
I wanna play something on live i'll go buy an unmodded Xbox 3fixme and play the shit legit.
Keep this modded one for games like Bioshock and Dead Space and shit that really has no online worth.

i played the saints row 2 review copy and unlocked an achievment which had no date just said unlocked, now on my new unbanned modded machine if i recover my gamertag an it has all the games ive played will i get banned again???? ive formatted my HDD so its clean? help

im on a mobile internet connection (7.2mbit) and playing anything online is almost impossible, so i only get on Live to get updates for the games =P

Also as far as achievement logging goes you are assuming that EVERYONE has their xbox time and date set correctly. If you have your time and date set for some ridiculous day like Nov. 13th 2012 then it will record your achievement with that stamp . So I dont think achievement logging has much to do with it.

is that fact? if it is that ok, i played mirrors edge last night (thurs 15th nov) and ulocked a few acheivments, and it didnt come out till today, im from the uk, my console was banned yesterday morning also, so this should definitley not affect my new modded one when i recovery my gamertag?? dont want to recovery it yet untill i get some clarification yo see.. im thinking of waiting till the new dashboard upsate comes out then just do it all then. only 5 days???what do you think??

well im sure MS has a team looking for people who log in to Live with achievements from games not released yet, and as u said, just a day before the releasedate they would probably look extra hard lol.. think of all the people who come online with games before they are released as FLIES, and think of M$ as a big bunghole with a FLYSWAPPER, or even worse a FLYZAPPER! and imagine them chasing you while yelling "DIE FLIES!! DIEEEE!! MoHaHaHaaa!"

I can DL my account into a friends unmodded xbox and play games ... his box won't be banned. I can take my HDD from my box and put it on a $199 brand new basic xbox3fixme and import my account and they wont ban it.
If they were after accounts they would just disable the account all together instead they just disable the modded box from their live network.
Whats banned is your box and thats it and correct me if i'm wrong but i believe its done by serial number.

2 - when i connect back to live now with my formatted HDD and recovery my gamertag? can i download all my purchased arcade games again too?
3 - is it best to by a new live account and start my acheivments again as like plowerking said will they look at my recovered gamertag on the new modded console ans see my played games then it will show a game ive played a day before realease and ban me again???

well i say you will be fine with using the old harddrive with the new box WITHOUT getting banned, they only ban your serialnumber that is programmed into the eeprom and is changable, in otherwords if u pay a good enough computer engineer he would probably change it for you and get it unbanned too, but don't know how far this has come, maybe its still in trail-n-error...

yeah i was just looking at this as i will need to do the same thing sometime next year when i get another xbox.
I just logged into the xboxlive website with my registered email address and it told my what all licenses(to downloaded material) I have acquired and can transfer.
It says you can only do this once every 12 months though. You will need your new console there and have it hooked up to live. Then what it should do is transfer all the license info on games and content you purchased to the new system and then you will go to the store and have to DL it all again. Similar to if you bought something then deleted it from your HDD then later on wanted to play it again you could go back to the store and DL it for free because you already paid for it once. get what i'm saying?

This is BS. The text basically says that if you play a allstars released game you will get banned. Well, fist off. Allstars do not put anything on the iso that will actually tell M$ that it is a allstars release. AND, if you are on M$ ban-list you probably have been for months. They rarely ban someone the very instant they do something that violate their terms of usage.
So, disregard this text. M$ as usual has no "pattern" in their recent banning. People without modded xbox'es have been banned recently. That just shows that M$ really do not know what criteria they should look for in their banning.
Just keep to playing games AFTER the release date and do not brag about it and you should be safe. Or not... remember that people without modded consoles get banned also.

I always thought that i could swear by the dvdmulletter but from what i've been reading .... I now have my doubts.
I'm not sure that anything is 100% safe anymore thats why i'm just gonna roll with 2 consoles ... one modded and one legit. It will still save me loot in the long run but I will actually have to purchase games that i wish to play online. Which I don't have a problem with seeing as how there is usually only like 2 of those a year.
If you are an achievement junkie though this probably won't be enough of a solution for you. You will wanna register all achievements . ... I'm not really like that ... i just wanna play the games.

I got banned today and I never played COD WaW. But I did play Gears 2 and Fallout 3 well before the release date. I'm thinking the hard drive holds some info that pertains to who gets banned or not. I read someones post on Xbox-scene.com that they had 1 modded Xbox 360 and 1 -non-modded Xbox 360 and when putting the hard drive from the banned 360 on the new one it got banned as well...never flashed or anything. So I dunno really know what criteria Microsoft uses, but whatever they're using it really wrecks havok for even people that don't even mod their console.
Lastly I'd like to say to Microsoft, thank you for banning me in a time when I'm struggling to make it day to day with the cost of so many things, so I play my 360 online to help me get through these trying times. I guess it's an escape from reality, even if it's for just a few hours. They choose a fine time to ban people when we're all going through economic struggles at the moment (especially financially) (some of us got layed off). Thanks Microsoft you really come through you know!

And again no, nothing is saved on the harddrive, the serialnumber is sent to the Live servers everytime you login, and its only saved in the EEPROM which is located on the motherboard, just think of the guys with the Arcade system that doesn't have a harddrive, and if u say their memorycards saves info then by using that memcard in an other machine will get it banned? No sir..

well lol, are you sure u even burned PAL/Region Free rips? i have only used iXtrem 1.4, and for all i know, stealthed or not, it should be playable, so either its an error on your side, or the realeasegroup side...

It's a very simple solution, for those of you getting banned. Do NOT PLAY LIVE with a game that is not even released yet! You need to have an IQ equal to that of a mud fence, to do such a thing anyway. Unplug your Ethernet Cable or Wireless Networking adapter from the XBox before putting the game in the drive. I have been doing it like that for years, and have never had a ban, and I play them weeks before they are released.
Don't get greedy, just enjoy what you have!

Who ever said M$ wouldn't pay a group to release flagged games due to lost money.. M$ loses nothing on those games unless it's developed by M$. Your XBL subscription isn't refunded and you can't return your modded system for a refund. You have to buy another console to continue playing. Seems like a win/win for M$. The only thing they're not going to do is go public about it.
And I'm pretty sure a company as large as M$ has a Bell Canada attitude. They will spend $1000.00 to collect $0.01 from you. They're using you as an example.
